Alex Pretti’s family put out a statement after their son was murdered by ICE today. It looks like ten or so shots to the back killed him. The ICE agents even clapped for themselves after the murdered him in the most cowardly fashion possible. In the back while he was trying to protect a woman who had already been pushed down.

The democratic apparatus that would have voted for the ICE funding have now come out against supporting ICE funding after Alex Pretti’s murder by ICE agents. Impeach Kristi Noem language is popping up again but Trump is supporting the ICE agent who shot Alex Pretti.

Personal Perspective: The Domestic Terrorists are obviously the ICE and CBP agents bot Renee Good or Alex Pretti. I am not falling for the government lies. Hopefully everyone’s eyes are opening up and seeing the truth. Your support of Trump didn’t bring down the price of eggs. It didn’t get your pdf-ile in chief to release the Epstein Files. From where I sit voting for Trump was an act of TREASON for many reasons. RIP the Rule of Law in the US.

But if you will just pretend with me for a second. When we take back control of the US government from Trump and the MAGA treasonists, these ICE agents are looking at this in their future.

An ICE agent who murders a U.S. citizen can face criminal prosecution at both the state and federal levels, as federal agents are not immune from the law. The change in presidential administration does not alter the fundamental legal framework for prosecuting murder, which is a violation of established state and federal laws.

Legal Ramifications

  • Federal prosecutors can charge law enforcement officers for fatal shootings if the officer’s conduct was unlawful and violated the victim’s civil rights. The U.S. Department of Justice (DOJ) would investigate the incident, (after Trump is out of power).

  • State Prosecution: State and local authorities can also pursue investigations and criminal prosecutions against federal agents for violating state laws, such as murder or manslaughter.

    • Supremacy Clause: The primary legal hurdle for state prosecution is the Constitution’s Supremacy Clause, which generally protects federal officials from state interference when their actions are reasonably within the scope of their lawful federal duties.

    • Beyond Lawful Duties: If an agent acts “beyond the scope of their duties, violate federal law, or behave in an egregious or unwarranted manner,” state prosecutions can move forward. The key question in court would be whether the officer reasonably believed their actions were necessary to perform their federal duties.

    • Removal to Federal Court: A federal agent charged by a state has the right to move their case from state court to federal court if they can offer a plausible defense based on federal law.

  • Civil Lawsuits: Victims and their families can pursue civil litigation.

    • Federal Tort Claims Act (FTCA): Individuals can sue the federal government under the FTCA for injuries or death caused by federal employees acting within their employment.

    • Individual Liability: Suing individual federal officers for monetary damages for constitutional rights violations (known as a Bivens claim) has become very difficult due to recent Supreme Court decisions that have significantly weakened this avenue for accountability.

Use of Force Policy: ICE and DHS policies require officers to use the minimum non-deadly force necessary and resort to deadly force only when they have a “reasonable belief that the subject of such force poses an imminent threat of death or serious bodily injury”. An agent who uses force outside these guidelines would be subject to prosecution.
